  1. Your per­so­nal data will be col­lec­ted by Sel­as & Part­ners and (an) exter­nal processor(s).
  2. Per­so­nal data means any infor­ma­ti­on rela­ting to an iden­ti­fied or iden­ti­fia­ble natu­ral per­son (‘data subject’).
  3. An iden­ti­fia­ble natu­ral per­son is one who can be iden­ti­fied, direct­ly or indi­rect­ly, in par­ti­cu­lar by refe­ren­ce to an iden­ti­fier such as a name, an iden­ti­fi­ca­ti­on num­ber, loca­ti­on data, an onli­ne iden­ti­fier or to one or more fac­tors spe­ci­fic to the phy­si­cal, phy­si­o­lo­gi­cal, gene­tic, men­tal, eco­no­mic, cul­tu­ral or soci­al iden­ti­ty of that natu­ral person.
  4. The per­so­nal data that are col­lec­ted on the web­si­te are used main­ly by the col­lec­tor in order to main­tain a (com­mer­ci­al) rela­ti­ons­hip with you and if appli­ca­ble in order to pro­cess your orders. They are recor­ded in an (elec­tro­nic) register.

The con­trol­ler takes approp­ri­a­te tech­ni­cal and orga­ni­za­ti­o­nal mea­su­res in accor­dan­ce with the legal requi­re­ments, taking into account the sta­te of the arts, the costs of imple­men­ta­ti­on and the natu­re, sco­pe, con­text and pur­po­ses of pro­ces­sing as well as the risk of varying like­li­hood and seve­ri­ty for the rights and free­doms of natu­ral per­sons, in order to ensu­re a level of secu­ri­ty approp­ri­a­te to the risk.

The­se mea­su­res inclu­de, in par­ti­cu­lar, safe­gu­ar­ding the con­fi­den­ti­a­li­ty, inte­gri­ty, and avai­la­bi­li­ty of data as well as access to ensu­re that data sub­jects’ rights are res­pec­ted, that data is era­sed, and that the con­trol­ler is pre­pa­red to res­pond to data thre­ats rapid­ly. Fur­ther­mo­re, the con­trol­ler takes the pro­tec­ti­on of per­so­nal data into account as ear­ly as the devel­op­ment or selec­ti­on of hard­wa­re, soft­wa­re and ser­vi­ce pro­vi­ders, in accor­dan­ce with the prin­ci­ple of pri­va­cy by design and pri­va­cy by default.

Arti­cle 8 — Your rights regar­ding information

  1. Rights of Data Sub­jects As a data sub­ject, you are entit­led to various rights under the GDPR, which ari­se in par­ti­cu­lar from Arti­cles 15 to 18 and 21 of the GDPR:

  5. Right of access: You have the right to request con­fir­ma­ti­on as to whe­ther the data in ques­ti­on will be pro­ces­sed and to be infor­med of this data and to recei­ve fur­ther infor­ma­ti­on and a copy of the data in accor­dan­ce with the pro­vi­si­ons of the law.
  6. Right to rec­ti­fi­ca­ti­on: You have the right, in accor­dan­ce with the law, to request the com­ple­ti­on of the data con­cerning you or the rec­ti­fi­ca­ti­on of the incor­rect data con­cerning you.

Right to Era­su­re and Right to Restric­ti­on of Pro­ces­sing: In accor­dan­ce with the sta­tu­to­ry pro­vi­si­ons, you have the right to demand that the rele­vant data be era­sed imme­di­a­te­ly or, alter­na­ti­ve­ly, to demand that the pro­ces­sing of the data be restric­ted in accor­dan­ce with the sta­tu­to­ry provisions.

Arti­cle 9 — Legal obligations

  1. In case of infrin­ge­ment of any law or regu­la­ti­on, of which a visi­tor is sus­pec­ted and for which the autho­ri­ties requi­re the per­so­nal data col­lec­ted by the col­lec­tor, they will be pro­vi­ded to them after an expli­cit and rea­so­ned request of tho­se autho­ri­ties, after which the­se per­so­nal data do not fall any­mo­re under the pro­tec­ti­on of the pro­vi­si­ons of this Pri­va­cy policy.
  2. If any infor­ma­ti­on is neces­sa­ry in order to obtain access to cer­tain fea­tu­res of the web­si­te, the con­trol­ler will indi­ca­te the man­da­to­ry natu­re of this infor­ma­ti­on when reques­ting the­se data.

Arti­cle 11 — Data retention

The col­lec­ted data are used and retai­ned for the dura­ti­on deter­mi­ned by law. The data pro­ces­sed by the col­lec­tor will be era­sed in accor­dan­ce with the sta­tu­to­ry pro­vi­si­ons as soon as their pro­ces­sing is revo­ked or other per­mis­si­ons no lon­ger apply (e.g. if the pur­po­se of pro­ces­sing this data no lon­ger applies or they are not requi­red for the purpose).

If the data is not dele­ted becau­se they are requi­red for other and legal­ly per­mis­si­ble pur­po­ses, their pro­ces­sing is limi­ted to the­se pur­po­ses. This means that the data will be restric­ted and not pro­ces­sed for other pur­po­ses. This applies, for example, to data that must be sto­red for com­mer­ci­al or tax rea­sons or for which stor­a­ge is neces­sa­ry to assert, exer­ci­se, or defend legal claims or to pro­tect the rights of ano­ther natu­ral or legal person.
